In 1981, the 73rd General Assembly of the State of Arkansas voted in favor of Act 590, a bill requiring the balanced treatment of creation-science and evolution. It was signed into law by Governor Frank White on March 19 of the same year. The Bill was quickly challenged in court. The case, McLean V. Arkansas Board of Education, was heard before U.S. District Court Judge William R. Overton.
The Judicial decision of Judge Overton was entered on January 5, 1982 and found in favor of the plaintiffs. In his Memorandum Opinion, Judge Overton wrote that the essential characteristics of (natural) science are:
1. It is guided by natural law;
2. It has to be explanatory by reference to natural law;
3. It is testable against the empirical world;
4. Its conclusions are tentative, i.e. are not necessarily the final word; and
5. It is falsifiable. (Ruse and other science witnesses).
Judge Overton rejected the scientific basis for creation-science. However, the same standard was not applied to Darwin's unplanned evolution.
